Welcome to Casual Encounters South Africa. These Terms of Service ("Terms") govern your access to and use of the Casual Encounters South Africa website, including any content, functionality, and services offered on or through casualencounters.co.za (the "Platform").

By accessing or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Platform.

4. User Conduct and Responsibilities

• Use any automated means, including bots, scrapers, or crawlers, to access or collect data from the Platform without our prior written consent.
• Upload viruses, malware, or any other malicious code.
• Share content from private conversations without the other person's consent.

5. Content Guidelines

You retain ownership of the content you post, upload, or share on the Platform ("User Content"). By submitting User Content, you grant Casual Encounters South Africa a non-exclusive, worldwide, royalty-free licence to use, display, and distribute your content in connection with operating and promoting the Platform.

You are solely responsible for your User Content and the consequences of posting it. You agree that your User Content will not:

• Contain nudity, sexually explicit material, or pornographic content.
• Include hate speech, threats, or content that incites violence or discrimination.
• Violate the intellectual property, privacy, or publicity rights of any third party.
• Misrepresent your identity, age, or relationship status.
• Contain commercial solicitations, spam, or unauthorised advertising.

We reserve the right, but are not obligated, to review, flag, remove, or refuse any User Content that we believe, in our sole discretion, violates these Terms or could harm the Platform or its users.

6. Privacy

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for your personal, non-commercial use.

The Platform may contain links to third-party websites or services that are not owned or controlled by Casual Encounters South Africa. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

You acknowledge and agree that Casual Encounters South Africa shall not be liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any third-party websites or services.

9. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, Casual Encounters South Africa disclaims all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Warranties that the Platform will be uninterrupted, secure, error-free, or free of viruses or other harmful components.

We make no guarantees about the conduct of other users, the quality of interactions, or the outcome of any connections made through the Platform. You use the Platform at your own risk.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Casual Encounters South Africa, its directors, employees, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of profits, data, use, goodwill, or other intangible losses — arising out of or in connection with:

• Your use of or inability to use the Platform.
• Any conduct or content of any third party on the Platform, including any defamatory, offensive, or illegal conduct.
• Unauthorised access, use, or alteration of your transmissions or content.
• Any personal injury or property damage resulting from your use of the Platform or meetings arranged through it.

In no event shall our aggregate liability to you for all claims arising out of or relating to these Terms or the Platform exceed the amount you have paid to us, if any, in the twelve (12) months preceding the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

11. Termination

We reserve the right to suspend or terminate your account and access to the Platform at any time, with or without notice, for any reason, including but not limited to:

• Conduct that we believe, in our sole discretion, is harmful to other users, the Platform, or our business interests.
• Extended periods of account inactivity.

You may terminate your account at any time by contacting us or using the account deletion option within the Platform. Upon termination, your right to use the Platform ceases immediately. Any provisions of these Terms which by their nature should survive termination — including intellectual property rights, disclaimers of warranties, limitation of liability, and governing law — will continue to apply.

12. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions.

Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be subject to the exclusive jurisdiction of the courts of South Africa.

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. When we make material changes, we will post a notice on the Platform and update the effective date at the top of this page. Your continued use of the Platform after such modifications constitutes your acceptance of the new Terms.
